The community around Crown Heights, Brooklyn is mourning a recent tragic, fatal car accident involving a 69-year-old driver and eight-year-old pedestrian. According to the police, the incident occurred at around 5:30 P.M. on June 28th.
The eight-year-old child was reportedly crossing the street at the intersection of Albany Avenue and Eastern Parkway. The vehicle was traveling southbound and hit the victim.
A witness to the accident says they were riding in the backseat of the car that struck the victim as an Uber passenger. According to the passenger, the driver immediately stopped when they struck the child and began screaming. The driver called 911 without hesitation and was extremely concerned about the child’s wellbeing.
As the nearby witnesses attempted to help the boy, the driver went into shock. The boy also had a sister with him at the scene who also appeared to be in shock. Firefighters and an ambulance were able to make it to the scene within five minutes, and they quickly transported the child to Kings County Hospital. Unfortunately, he was declared deceased at the hospital.
Police are still investigating what happened. What is clear is that the driver stayed at the scene until the authorities arrived, and no arrests have been made in the situation.
The Legal Implications of a Fatal Accident
A fatal pedestrian accident causes widespread damage for everyone who is impacted by it. While nothing can replace the unfortunate loss of life, there is legal recourse for the impacted family of the fatally injured individual.
Families can pursue criminal charges against the responsible party if the situation warrants it. For instance, if the driver was intoxicated, driving recklessly, or fled the scene of the accident, then it’s possible to contact the police and request the opening of a criminal case. Criminal charges could potentially put the party responsible in jail. It could also result in substantial fines and fees.
Families can also pursue a civil claim against the responsible party to recover financial compensation for their losses. This type of claim can require the responsible party to pay a significant amount of money to the impacted family.
